Rates & Usage
The following terms and conditions are set forth to provide a simple and clear communication to our clients.
Unlimited Usage Policy – Vivant is providing unlimited local and long distance to our client, this unlimited plan is subject to fair usage policy. This policy is designed to protect the quality and integrity of the VoIP network and in doing so ensure all customers receive fair and equitable access. The policy specifically relates to usage of flat rate calls and free calls. Vivant may depend on its Fair Use Policy in circumstances where your usage of flat rate or free untimed call charges that form part of a pricing plan or promotional offer is deemed to be excessive or unreasonable. Vivant retains the right to adjust the terms of the Fair Use policy at our discretion from time to time when necessary.
Unreasonable or Excessive use – If your use of the plan is excessive or unreasonable, such as, but not restricted to, duration of call(s); call initiated, terminated and subsequently re-dialled many a times; calls made to a single number; number of calls made during your billing month; regular call forwarding; and any other irregular patterns that is not included here, we will inform you via an automated message, phone call or email, using the contact details you have provided to us. If after our request your usage continues at a similar level we may change you to an appropriate business plan, then charge you at the rates for that plan and backdated to when we made contact.
Vivant further considers your use of the service to be unreasonable or excessive if you reduce or limit the ability of other customers to access our VoIP network as you:
- Use the VoIP service for any other purpose than function of person-to-person voice communication
- Engage in the bridging of conference calls or conference call scams
- Use of VoIP service line as a hot line, radio station
- Use more than 4000 minutes per each user or extension per billing cycle or use more than 7500 minutes overall on your account per billing cycle
Additional Charges – As per your agreement, any phone calls made to premium numbers such as 1-900 numbers, 411 directory, collect calls and international charges will be billed to your account based on actual usage. For security and safety, we block all international calls unless requested by customer to allow international destinations, never-the-less, any international calls made will be billed to the customers’ account.
SmartCONNECT Usage Policy – SmartCONNECT backup Internet service is designed to keep your essential business services connected to the Internet during an outage of your primary Internet service. Business essential services are limited to any services that directly impact your business’s revenue and are limited to the POS system, Phone Service, Online Ordering Systems, and 3rd Party Delivery Services. SmartCONNECT usage excludes the usage of the service for CCTV Camera systems, Music Streaming, Social Media access, or other streaming services such as Netflix or YouTube for example. Unless otherwise notated in your agreement, your SmartCONNECT service is limited to a fair usage policy of 5GB per month and in an event that you have exceeded your monthly limit, Vivant will not throttle or disable the usage of the system but will bill you at an additional fee of $15 dollars per gigabyte of usage above your monthly 5GB limit.
Internet Service Monitoring (ISP) Fee – To ensure the highest level of service reliability for our customers, the $9.95 ISP monitoring fee covers proactive monitoring of your Internet Service Provider (ISP) for any outages. This fee supports the costs of licensing, servers, and the necessary infrastructure to maintain consistent internet connectivity. Additionally, it covers billing, issue resolution, and outage management of your internet service on your behalf. We believe this minimal fee provides substantial value, ensuring your business remains connected and operational at all times.
